About these terms
- These terms of use ("Terms") apply to your use of the InterSession client application (the "App") provided by InterSession Group Pty Ltd (ABN 40 694 587 150) ("InterSession", "we", "us" or "our"). The App lets you see information your treating practitioner has chosen to share with you, such as session summaries, resources and tasks, and lets you record check-ins and personal reflections.
- By creating an account, signing in, or using the App, you agree to these Terms. If you do not agree, please do not use the App. You can still receive care from your practitioner without using the App.
Please read section 1 carefully. It explains that the App is not a medical or emergency service.
The App is not medical advice or an emergency service
Not medical advice.
The App is a support and information tool. It does not provide medical, psychological or clinical advice, diagnosis or treatment. It does not replace your practitioner or any care they provide.
Not an emergency or crisis service.
The App is not monitored in real time. Your check-ins, reflections and any messages are not watched by a clinician as you submit them and may not be seen promptly. Do not use the App to seek urgent help.
In an emergency.
If you or someone else is in danger or needs urgent help, call 000 (Triple Zero) immediately. You can also contact Lifeline on 13 11 14, Kids Helpline on 1800 55 1800, or Beyond Blue on 1300 22 4636. These services are available 24 hours a day.
Talk to your practitioner.
For anything about your care, your treatment or your health, speak with your treating practitioner or another qualified health professional.
Your practitioner controls what you see
- Your practitioner uses InterSession to help document and support your care. What you see in the App is controlled by your practitioner. They decide which summaries, resources and tasks are shared with you, and when. InterSession does not decide what care you receive.
- If you have questions about anything shared with you in the App, or you think something is wrong, contact your practitioner.
Who can use the App
- You may use the App if your practitioner has invited you and you can form a binding agreement to these Terms.
- If you are under 15, a parent or legal guardian must agree to these Terms and consent to your use of the App on your behalf.
- If you are 15 to 17, you may use the App where you have the maturity and understanding to agree to these Terms; otherwise a parent or guardian must agree on your behalf. Your practitioner will help work out what is appropriate.
- Where a parent or guardian agrees to these Terms for a young person, references to "you" include both of them as the context requires.
Your account and access
You sign in to the App using a secure link or one-time code sent to your email. Please keep your email account and device secure, and let your practitioner know if you think someone else has accessed your App account. Do not share your access with others or use anyone else’s access.
Content you add
The App lets you add content such as mood check-ins, reflections and diary entries, including using voice-to-text on your device. When you add content:
- You keep ownership of what you write. We do not claim ownership of your content.
- You allow us to store and process your content to provide the App and support your care, including making it available to your treating practitioner. Your practitioner may be able to see the content you submit through the App.
- Voice reflections are converted to text on your device. We receive only the text, not an audio recording.
- We do not use your content to train artificial intelligence models, and we do not sell your information.
AI-assisted information
Some summaries and materials shared with you may have been prepared with the help of artificial intelligence and then reviewed and approved by your practitioner before being shared. AI can make mistakes. If something does not look right, do not rely on it and speak with your practitioner.
Acceptable use
Please use the App only for its intended purpose. You agree not to misuse the App, including by trying to access it unlawfully, interfering with how it works, attempting to access other people’s information, or using it in a way that breaks the law.
Privacy
We handle your personal and health information in accordance with our Privacy Policy and applicable privacy and health records laws, including the Privacy Act 1988 (Cth) and the Health Records Act 2001 (Vic). The Privacy Policy explains what we collect, how we use it, who we share it with, and your rights. You can withdraw your consent to using the App at any time by telling your practitioner and closing your account, although this does not affect care your practitioner provides outside the App.
Our rights in the App
We own the App and everything in it except your own content and anything your practitioner provides. You may use the App only as allowed by these Terms.
Availability and "as is" service
We work to keep the App available and secure, but we cannot promise it will always be available, uninterrupted or error-free. To the extent permitted by law, the App is provided "as is" and "as available". This does not affect your rights under the Australian Consumer Law, which cannot be excluded.
Our liability to you
- Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot be excluded, or our liability for death or personal injury caused by our negligence.
- Otherwise, and to the maximum extent permitted by law, we are not liable for any indirect or consequential loss, and our total liability to you in connection with the App is limited to re-supplying access to the App or paying the cost of doing so. You remain responsible for your own decisions about your health and care.
Suspension and closing your account
We may suspend or limit access to the App if it is being misused or to protect users or the App. You can stop using the App at any time and ask your practitioner to remove your access. If your account is closed, information is dealt with as described in the Privacy Policy.
Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will let you know, for example by a notice in the App or by asking you to accept the updated Terms. If you continue to use the App after a change takes effect, you accept the updated Terms.
Governing law
These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria.
